Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and the operator of kubbi.ai regarding your use of kubbi.ai, the kubbi API, SDKs, MCP integrations, dashboard, documentation, and related services (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you accept these Terms on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Services.

1. What kubbi does

kubbi is a temporary handoff service. A producer stores a payload, receives a claim URL, and another actor (human or automated) claims the payload later. Payloads are encrypted at rest using AES-256-GCM, each with a unique initialization vector and authentication tag. Payloads are temporary by design: every kubbi expires automatically based on its configured time-to-live and retrieval limits.

kubbi is not a backup service, archive, or system of record.

2. Accounts and access

You must be legally able to enter into these Terms. You are responsible for all activity under your account, API keys, team seats, and credentials, and you must keep them secure. Notify us promptly at support [at] kubbi.ai if you believe your account or API keys have been compromised.

3. Claim URLs are bearer credentials

Claim URLs are bearer credentials. Anyone who possesses a valid claim URL may be able to inspect metadata and claim the associated payload. kubbi does not authenticate consumers of claim URLs.

You are responsible for protecting claim URLs and sharing them only through channels appropriate for the sensitivity of the payload. You are also responsible for choosing appropriate TTLs and retrieval limits, and for revoking or deleting kubbis when access is no longer needed.

kubbi is not liable for unauthorized access resulting from claim URLs being leaked, logged, forwarded, cached, indexed, intercepted, or otherwise disclosed outside kubbi’s systems.

4. Customer data

You retain ownership of the data, files, payloads, text, metadata, and other content you or your users send through the Services (“Customer Data”). You grant kubbi a limited, non-exclusive license to host, store, encrypt, transmit, and process Customer Data as reasonably necessary to provide and secure the Services, comply with law, and enforce these Terms.

You represent that you have all rights and lawful basis needed to provide Customer Data to kubbi, and that your use of the Services will not violate applicable law or third-party rights.

kubbi is not designed or certified for use with protected health information (PHI) subject to HIPAA, payment card data subject to PCI-DSS, data subject to ITAR or EAR, classified government data, or children’s data subject to COPPA, unless a separate written agreement expressly permits such use. If you send regulated data through kubbi without an applicable agreement, you do so at your own risk and you will indemnify kubbi for any resulting claims or liabilities.

We may use aggregated or de-identified usage data that does not identify you or the contents of Customer Data to operate and improve the Services.

5. Acceptable use

You may not use the Services to violate any law or regulation; upload or distribute malware, phishing content, or other harmful material; interfere with the security or availability of the Services; abuse quotas, usage limits, or billing rules; infringe intellectual property or privacy rights; or store content that is unlawful, exploitative, or abusive.

If you integrate kubbi into automated pipelines, AI agents, or other software systems, you are responsible for the behavior of those systems, including how they handle API keys, claim URLs, and retrieved payloads.

6. Fees and payment

Paid plans are billed through Stripe. Subscription fees are billed in advance unless otherwise stated. Subscriptions renew automatically until cancelled. Fees are non-refundable except as required by law. We may suspend access to paid features for nonpayment.

7. Payload lifecycle and deletion

kubbi overwrites encrypted payloads when a kubbi is burned, deleted, or expires. Deletion may not be instantaneous. Transient copies in caches, replication buffers, or infrastructure components may persist briefly beyond the payload lifecycle. Operational metadata (such as creation timestamps, content types, sizes, and expiry settings) may be retained as described in our Privacy Policy.

Deleted, expired, or burned payloads may not be recoverable.

8. Beta features

Some features may be offered on a beta or preview basis. Beta features are provided as-is, may change or be removed at any time, and are excluded from any service-level commitments or warranties.

9. Third-party services

The Services rely on third-party infrastructure, including Vercel, Railway, Neon, Stripe, and Resend. Your use of the Services is also subject to those providers’ terms and policies. We are not responsible for third-party services we do not control.

10. Intellectual property

kubbi and its licensors own the Services, including the software, documentation, website content, branding, and all related intellectual property rights. No rights are granted to you except as expressly stated in these Terms. If you provide feedback or feature requests, you grant us a worldwide, perpetual, royalty-free right to use them without restriction.

11. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, if your use presents a security risk, if payment is overdue, or if required by law. We may also discontinue the Services or any feature at any time. On termination, your right to use the Services ends and inaccessible Customer Data may not be recoverable.

12. Disclaimers

The Services are provided “as is” and “as available.” To the maximum extent permitted by law, kubbi disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or fully secure, or that any data will be retrievable before expiry, deletion, or read-limit exhaustion. The Services do not include a service-level agreement or uptime guarantee unless separately agreed in writing.

13. Limitation of liability

To the maximum extent permitted by law, kubbi will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or business interruption. kubbi’s total liability arising out of or relating to the Services or these Terms will not exceed the greater of (a) the amounts you paid kubbi during the 12 months before the event giving rise to the claim, or (b) US $100.

14. Indemnification

You will defend, indemnify, and hold harmless kubbi, its affiliates, and their officers, directors, employees, and agents from any third-party claims arising out of your Customer Data, your use of the Services, your violation of these Terms or applicable law, or your distribution or misuse of API keys, claim URLs, or retrieved data.

15. Governing law

These Terms are governed by the laws of the State of California. Any dispute will be brought exclusively in the state or federal courts located in California, and both parties consent to personal jurisdiction there.

16. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and update the effective date. If changes are material, we will provide additional notice where required by law. Continued use of the Services after the updated Terms become effective constitutes acceptance.

17. General

These Terms, together with the Privacy Policy, form the entire agreement between you and kubbi regarding the Services. You may not assign these Terms without our prior written consent. Failure to enforce any provision is not a waiver. If any provision is unenforceable, the remaining provisions remain in effect.
